The Court of Appeal in Abuja yesterday adjourned indefinitely, the appeal filed by the National Chairman of the All Progressives Congress (APC), Adams Oshiomole, challenging his suspension from office.
Before then, the appellate court had on Monday stayed the execution of the ruling of the High Court of the Federal Capital Territory (FCT) suspending him from the party and fixed Friday, March 20 for hearing.
But when the matter came up yesterday, a clerk of court announced that they would not be able to sit and that a new date would be communicated to the parties.
But a source at the Court of Appeal told Daily Trust that the matter may have been suspended due to the directive by the APC to withdraw all court cases and seek an amicable resolution of the crisis in the party.
In the Notice of Appeal number: FCT/HC/CV/837/2020, Oshomhole asked the appellate court to allow the appeal and set aside the ruling of the high court delivered on March 4.
The application, which has four grounds of appeal, joined the following ward members of APC in Edo as respondents: Comrade Mustapha Salihu, Anselm Ojezua, Alhaji Sani Gomina, Hon. Fani Wabulari, Evangelist Princewilll Ejogharado, the Inspector General of Police, and the State Security Services.
Oshomhole in the application is contending that the issues determined by the High Court at the interlocutory stage are issues that ought to be decided at the substantive stage.
Meanwhile, an aggrieved member of the party and the Director General of the Voice of Nigeria (VON), Chief Osita Okechukwu, has insisted that Oshiomole is no longer a valid member of the party.
Okechukwu who spoke after the court session on behalf of the ‘Oshiomhole Must Go’ group, stated that the main issue remains whether a man suspended by his ward executive can preside over same association.
“The truth is that Comrade Adams Oshiomhole is no longer a valid member of APC. Don’t forget that Comrade validated the suspension of Barister Inua Abdulkadir, vice chairman North West, by his ward. It’s trite law that one cannot approbate and re-approbate,” he said.
