A Federal High Court in Abuja has re-assigned the suit challenging the office of Governor Atiku Bagudu of Kebbi State for accelerated hearing.
The acting Chief Judge, Justice Abdul Kafarati, has re-assigned the pre-election suit filed in 2015, which was initially before the now retired Justice Adeniyi Ademola to Justice Ahmed Mohammed for accelerated hearing.
A preliminary objection to the suit which was filed before Justice Ademola was taken to the Supreme Court but was in November struck out and returned to the Federal High Court.
In the originating summons, the Peoples Democratic Party (PDP), whose candidate, Maj. Gen. Bello Sarkin Yaki (Rtd), scored the second highest number of votes in the April 11, 2015, election, is seeking an order of the court to declare him the winner of the governorship election.
The PDP wants the court to hold that the incumbent governor who won the election was not qualified to contest because he does not possess the requisite academic qualification. They also claimed that Bagudu of the All Progressives Congress (APC) made a false declaration in the INEC form he submitted to the commission.
The case has been adjourned to January 11, 2018, for hearing.
