Petition against Lamido Adamawa: Judiciary staff remanded in prison

A Yola magistrate court yesterday remanded a 32-year-old man in prison after he attempted to serve a petition on the Lamido of Adamawa Dr Barkindo Aliyu Musdafa.

Mustapha Bakari Mbamoi, a staff of Adamawa State judiciary, was arrested last Friday at Lamido’s palace where he reportedly went to deliver a petition written by the solicitors of the Secretary of Adamawa Emirate Council over alleged illegal detention of the scribe on alleged misappropriation of funds.

When police arrested Mr Mbamoi at the palace, they accused him of trespass and subsequently charged him to court yesterday.

Police prosecutor Sergeant Iliya Akawu told the court that the accused person trespassed into the palace of Lamido on 22 February 2013, in contravention of section 342 of the penal code.

He said the action of the accused posed danger to the life of Lamido.

When the charge was read to Mr Mbamoi, he pleaded not guilty.

His counsel, Barrister Tahir Shehu, told the court that since he did not plead guilty, he should be granted bail.

He said the alleged offence was a bailable one.

He told the court that bail is a fundamental right of the accused and that if he satisfies its conditions, the court should use its discretion to grant it.

But the prosecutor opposed the bail application saying the police had not yet finished their investigation and stressing the sanctity of the premises where the alleged offence took place.

Magistrate Hauwa Batu set tomorrow Wednesday for ruling on the bail application and ordered that the accused person be remanded in prison.
