Ndume: Court refuses application for stay

A Federal High Court yesterday dismissed an application for stay pending the hearing of an appeal on evidence by Senator Ali Ndume who is standing trial over alleged terrorism.

Ndume is in Appeal Court Abuja Division challenging two interlocutory orders which permitted the tendering of three DVDs containing call data recordings allegedly between him and the Boko Haram.

In his ruling, Justice Gabriel Kolawole observed that the accused person had earlier filed a motion for stay in the court before filing a fresh one at the Court of Appeal.

He therefore granted 60 days interim order to conclude with the appeal before returning to the court. Defence counsel Ricky Tafa (SAN) had earlier prayed to withdraw a motion for stay because of the eventual entering of the appeal by the Appeal Court.

The case has been adjourned to May 6.
