Court acquits woman for allegedly killing hubby

Mrs Hadiza Abutu, standing trial in an Abuja High Court over alleged murder of her husband Ibrahim was yesterday acquitted and discharged.

Delivering judgement, Justice Abba Mohammed held that the prosecution failed to prove a case of culpable homicide and against the accused person.

Attorney General of the Federation (AGF) had on January 20, 2012 arraigned Hadiza on two counts charge of culpable homicide and the destruction of evidence over the death of Ibrahim in his bedroom.

Prosecution counsel Ejike Orji had urged the court to attach weight to the testimony of the deceased’s brother Dr Gabriel Abutu that he nodded in affirmation that he was killed by his wife.

But the judge ruled that mere nodding from the deceased who was wearing an oxygen mask could not be admissible as a dying declaration adding that the witness’ statement was based on mere suspicion.
