PDP asks court to suspend order on Oyinlola’s removal

The Peoples Democratic Party (PDP) has filed a motion for stay of an Abuja Federal High Court judgment which removed former Osun State governor Olagunsoye Oyinlola from the position of the National Secretary of the party.

According to the documents filed by the party’s counsel Kwon Victory, PDP is seeking an order of injunction restraining the judgment creditors whether by themselves, agents, privies or assigns from seeking enforcement of the judgment delivered last Friday pending the hearing and determination of the party’s appeal before the Court of Appeal.

The party is equally seeking an order of stay of execution pending appeal of all orders of the court granted by way of reliefs contained in last Friday’s judgment pending the determination of the party’s appeal before the Court of Appeal.

The party submitted that by Order 32 rules 1, 2&4(1) and Order 56 rule 1 of the Federal High Court rules, the court is empowered to stay execution of all orders granted by a way of reliefs contained in last Friday’s judgment.

The court had in its judgment said Oyinlola is not fit to continue as national secretary because the South-West congress of the party which produced him as nominee was in violation of two separate orders of a Lagos Federal High Court which nullified the congress.
